对犯罪原因的分析一直是犯罪学研究的重点,在每个时期每个阶段由于社会的变化,其犯罪原因的内涵是不一样的。如果能对一个时期的犯罪原因进行有效分析,那么对预防以及更好的打击犯罪来说都具有积极的意义。作为新派刑法理论的代表人物,德国著名刑法学家,刑事社会学派创始人弗兰茨·冯·李斯特也认为,要想对犯罪进行有效的斗争,首先要认识犯罪的原因。是故,在其预防刑法理论中,对于犯罪原因的探析占有十分重要的位置。本文就将对其犯罪原因二元论理论进行评析,希望通过对其理论的研究来启发我们如何更好的预防现当代青少年犯罪问题。
The analysis of the causes of crime has always been the focus of criminological studies. At each stage of each period, due to social changes, the connotation of criminal causes is different. An effective analysis of the causes of crime in a given period can have positive implications for both prevention and better crime prevention. Franz von Liszt, the famous German criminal law scientist and founder of the criminal sociology school, also believes that in order to effectively fight crime, we must first understand the causes of crime. Therefore, in its prevention of criminal law theory, the analysis of the causes of crime occupy a very important position. This article will analyze the theory of the dualism of its causes of crime and hope that it will inspire us how to better prevent the problems of adolescent crimes in our generation through the study of its theory.
