有权力就应有监督,对权力的有效监督乃是控制其合法运行的重要保障,检察机关职务犯罪侦查权亦不例外。本文在分析我国职务犯罪侦查权监督制约机制现状的基础上,分析了其尚存在的问题及完善的必要性,并提出了完善该机制的构想,以期我国职务犯罪侦查权的监督制约机制不断得到加强,进而有利于检察机关打击职务犯罪、保障人权,促进司法公正和社会和谐。
Having power should be supervised. Effective supervision of power is an important guarantee for controlling its lawful operation. Procuratorial organs have the right to investigate crimes in respect of job-related crimes as well. Based on the analysis of the status quo of the supervision and control mechanism of the duty of investigation in our country, this paper analyzes its existing problems and the necessity of its perfection, and puts forward the conception of perfecting the mechanism. With the expectation that the supervision and restriction mechanism of the duty of investigation of the duty crimes will be continuously obtained Strengthen and then help prosecutors crack down on job-related crimes, safeguard human rights and promote judicial fairness and social harmony.
