宅基地是我国农村土地的重要组成部分,宅基地的权利在于农民,而农民使用农村宅基地权利的基本财产权以及是否可以转让问题一直是公众关注的焦点。在如今的中国农村中闲置的宅基地大面积荒废,“隐形”流转导致法律纠纷不断增多,文章在中共十八大三中全会对农村宅基地的使用权改革做出若干规定的政策背景下,论述了湖北省恩施市农村居民点用地的规范和态度权转让以及司法实践的现状。
