中国《物权法》随着改革开放的不断深化而诞生,期间经历过波折并随着时代变化而不断修正和完善。研究《物权法》对私权的保护正在于结合其时代性和发展性,找到以辩证方法正确看待其对私权保护的途径。本文通过分析《物权法》对社会发展的重要性阐释了《物权法》中涉及私权保护的积极意义,并就正确理解《物权法》中的私权保护提出了若干建设性意见。
China’s “Property Law” was born with the deepening of reform and opening up. It has undergone twists and turns and has constantly been revised and improved as the times change. To study the protection of private rights in the Real Right Law is to find a way of dialectically viewing its protection of private rights in light of its age and development. By analyzing the importance of “Property Law” to the development of society, this paper expounds the positive meaning of the protection of private rights in “Property Law” and puts forward some constructive suggestions on the correct understanding of the protection of private rights in “Property Law”.
