近几年,无人认领尸体问题在我国各地普遍存在,已经成为公众关注的社会问题。本文通过广州市无人认领尸体积压的现状,揭示了问题存在的根本,并在“法”、“理”、“情”的基础上提出了相应的处理对策。长期以来,无人认领尸体积压的情况在我国各地普遍存在,北到内蒙古、黑龙江,南到贵州、云南等地,无人认领尸体问题一直困扰着当地的公安、民政和卫生部门。过去,此类问题往往通过行政手段就可以得到解决,但是随着社会的发展,人们法律意识的增强,由于无人认领尸体引起的法律诉讼案件日趋上升。为了避免法律纠纷,相关部门都不愿意出具处理意见,而殡仪馆又不能自行处理,导致无人认领尸体长期积压。无人认领尸体的积压问题已成了全国各殡仪馆挥之不去的“痛”。
In recent years, the issue of unclaimed bodies has become widespread in various parts of our country and has become a social issue of public concern. In this paper, the status quo of unmanned dead bodies in Guangzhou is revealed, which reveals the root of the existing problems and puts forward corresponding countermeasures based on “law ”, “rationale ” and “affection ”. For a long time, the situation of unclaimed dead bodies has been widespread in various parts of our country. To the north of Inner Mongolia, Heilongjiang, south to Guizhou and Yunnan, the unclaimed dead bodies have plagued local public security, civil affairs and public health departments. In the past, such problems were often solved through administrative means. However, with the development of society, people are getting more legal awareness and legal proceedings due to unclaimed bodies are on the rise. In order to avoid legal disputes, the relevant departments are not willing to issue advice, and the funeral parlor can not handle it, resulting in long-term backlog of unclaimed bodies. The backlog of unclaimed bodies has become the lingering “pain” of all funeral parlors throughout the country.
