送达是人民法院民事审判活动中的一个重要环节,目前由于人员流动、单位变迁、规避和拖延诉讼等原因,送达难依然困扰着司法实践,人民法院越来越多地采用了推定送达方式。作为一种法律拟制,推定送达是司法程序矛盾和妥协的产物,也是审判公正和审判效率相互冲突下作出的无奈选择。在民事诉讼中,推定送达主要包括公告送达、留置送达、邮寄送达、当庭宣判和定期宣判等形式。其中公告送达是推定送达中最主要的方式,也最特殊、问题最多。公告送达是指人民法院通过登报、张贴公告等方式将法律文书的内容予以公布,通告受送达人在规定的时间和指定的地点,受领法律文书或参加诉讼事项,经过法定期间即推定已送达给被送达人的送达方式。我国《民事诉讼法》第84条规定:“受送达人下落不明,或者用本节规定的其他方式无法送达的,公告送达。自发出公告之日起,经过六十日,即视为送达。公告送达,应当在案卷中记明原因和经过。”最高人民法院《关于适用〈中华人民其和国民事诉讼法〉若干问题的意见》(以下简
