刑事犯罪及与刑事犯罪的斗争,已经历史性地进入了新阶段,作为突出侵财型的盗窃犯罪更不例外。“犯罪和现行统治都产生于相同的条件”,盗窃犯罪,正随着整个社会生活所受到的市场经济条件下不同层次的刺激和影响而发生着前所未有的变化;其量的猛增与质的恶化及其辐射力、影响力到了一种过去不能比拟的程度。无论是作案主体还是作案动机,作案形式还作案手段,犯罪成员还是侵害对象,盗窃犯罪本身还是作为该罪种温床的社会丑恶现象,都出现了有别于以前的特点,其原因也已不再是“为解饥寒”的单一欲望或社会某些部门管理防范机制的疏漏。本文从法理学及心理学、教育学、逻辑学、哲学的角度,以现状、特点、原因作为分析线索,对当今盗窃犯罪这一微观领域进行了较全面的考察,并通过提出“以严治乱”和“主体自我控制养成”等长期效应的对策思想,以期对盗窃犯罪实行标本兼治提供一定科学的理论依据。
