各省、自治区、直辖市及计划单列市外经贸委(厅): 为了规范外商投资股份公司上市。现就有关问题通知如下: 一、设立外商投资股份公司或现有的外商投资有限责任公司申请转为外商投资股份公司,须符合《关于设立外商投资股份有限公司若干问题的暂行规定》的要求并按规定程序报外经贸部审批。二、现有外商投资股份公司申请上市发行A股或B股,应获得外经贸部书面同意并应符合下列条件: (一)申请上市与上市后的外商投资股份公司应符合外
