中国的农民工作为日益被边缘化的新弱势群体,其合法权益保障缺失是当前构建和谐社会的主要矛盾之一。农民工合法权益保障缺失的原因不在于法律制度供给不足,而恰恰在于法律、政策没有得到有效实施。因此,解决农民工权益保障问题应当启用“问责制”,通过建立保障农民工权益的长效机制,保证现行法律、政策和措施切实得以落实。
China’s migrant workers are newly disadvantaged groups that are becoming increasingly marginalized. The lack of safeguard of their legitimate rights and interests is one of the major contradictions in building a harmonious society. The reason for the lack of protection for the legitimate rights and interests of migrant workers lies not in the inadequate supply of the legal system but precisely because laws and policies have not been effectively implemented. Therefore, to solve the problem of safeguarding the rights and interests of migrant workers, the “accountability system” should be adopted. By establishing a long-term mechanism for safeguarding the rights and interests of migrant workers, the existing laws, policies and measures can be effectively implemented.
