政府采购伴随国家的产生而产生,随世界贸易的拓展而发展。世界贸易组织(简称WTO)于1994年发布《政府采购协定》(Government Procurement Agreement,以下简称GPA),倡导各国政府间采购的国民待遇原则或非歧视原则。如何建立完善政府采购制度以有效规范政府采购行为,是各国政府以及国际组织共同面对之议题。WTO框架下,中国政府目前还没有签署政府采购协议(GPA),但随着近期中澳自由贸易协定(FTA)的签订,实质上是中澳两国议定有关GPA的条款,标志着中国自贸区高标准升级。在GPA框架下完善我国政府采购法律制度,日益受学界及实务界的广泛关注。
Government procurement is accompanied by the emergence of the state and develops with the expansion of world trade. The World Trade Organization (“WTO”) released the “Government Procurement Agreement” (GPA) in 1994 to advocate the principle of national treatment or non-discrimination on the basis of intergovernmental procurement. How to establish and improve the government procurement system to regulate government procurement effectively is a common issue that all the governments and international organizations face. Under the WTO framework, the Chinese government has not yet signed the GPA. However, with the recent signing of the China-Australia Free Trade Agreement (FTA), the agreement between the two countries on GPA is essentially a sign of China’s free trade District high standard upgrade. Under the GPA framework to improve China’s government procurement legal system, increasingly by the academic community and the practice of widespread concern.
