书证是民事诉讼中非常重要的一类证据,但有时由于某些原因当事人无法提供书证原件而只能提供书证复制件。那么哪些可以被叫做书证复制件,书证复制件在哪些条件下可以使用,它的证明力如何都成为重要的问题。目前我国在这方面的立法还比较少,建议借鉴英美法系在这方面的规定来完善我国的书证复制件的立法,促使诉讼更加便利和公正。
Documentary evidence is a very important type of evidence in civil lawsuits, but sometimes for some reason the parties can not provide the original documentary evidence and can only provide a copy of the documentary evidence. So what can be called a copy of a card, under what conditions a copy of the card can be used, and how its proof has become an important issue. At present, our legislation in this area is still relatively small. We suggest that we draw lessons from the Anglo-American legal system in this respect to improve our legislation on the copying of documentary evidence and to facilitate litigation more conveniently and fairly.
