舆论对于司法有着直接或潜在的影响,舆论的导向和社会的压力在一定程度上会干涉司法的行使,但同时也对司法进行必要的监督。在法律职业发达的美国,法官在对大众舆论的意愿上采取包容并兼的态度。而在中国的传统法官以至于现代法官的心中,都倾向于平民化、大众式的裁断方式,让民众的意愿可以在判决中得以体现。中美对此问题上的差异性具有一定的启示意义。
Public opinion has a direct or potential impact on the judiciary. The guidance of public opinion and social pressure will interfere with the exercise of the judiciary to a certain extent, but it will also provide the necessary supervision over the administration of justice. In the United States, where the legal profession is well-established, the judge adopts an inclusive and consistent attitude toward the public opinion. However, in the minds of traditional Chinese judges and even modern judges, they tend to be civilized and massively judged so that the will of the people can be reflected in judgments. The difference between China and the United States on this issue has certain enlightenment significance.
