目前,上海房地产市场正日趋规范,由商品房销售引起的纠纷也有所减少,但商品房预订过程中仍有不规范操作发生:无预售许可证却擅自预订,预订协议不合理、订金数额过大,开发商随意“拗断”购房者订金等等。上海市房地局已正式发文,规定商品房订金数额不应超过房款总价千分之五,并对商品房预订协议的内容及有关预订行为作出界定。
