社区矫正这个概念不是中国本土提出的,而是由国外传来,可以被翻译为依托社区开展的矫正活动。对于社区矫正的概念即使在其发展最为成熟的美国,也没有形成一个系统的、被大家认可的结论。我国社区矫正是在21世纪才开始的探索,目前在北京、天津、上海、江苏等地方进行试点测试。中国的社区矫正发展的比较晚,自然也存在很多问题,但是我们还是应该在质疑声中看到社区矫正制度发展的前景和必然趋势,本文将对国外社区矫正问题的梳理,运用比较法来试图解决中国社区矫正进行中存在的一些问题。
The notion of community correction, which was not proposed by China itself, but came from abroad, can be translated into corrective activities relying on the community. Even the most sophisticated development in the United States, the concept of community correction, has not resulted in a systematic and generally accepted conclusion.
