1990年立陶宛脱离苏联后,这个东欧小国面临重建知识产权保护体系的难题。1992年,立陶宛组建了国家知识产权保护机构——国家专利局,并以独立国家的身份加入国际知识产权组织(WIPO)。在独立后的第一个十年中,立陶宛先后颁布了《商标与服务标识法》(1993年)、《专利法》(1994年)与《著作权与邻接权法》(1999年)等涉及知识产权保护的一系列重要法律法规。进入21世纪后,为了筹备加入欧盟,立陶宛在知识产权领域不断改进并引入了欧盟的相关立法。2004年5月1日,立陶宛加入欧盟,成为欧盟知识产权保护体系中的重要成员。过去数年间,欧盟为了鼓励创新和激发区域内的经济活力,大力促进知识产权立法改革。立陶宛作为欧盟成员国,也不断完善本国的知识产权保护体系。其问,最显著的成果是2004年第三次修订的《著作权与邻接权法》、2010年的新《专利法》和2012年第四次修订的《商标法》。这三部法律不仅体现出立陶宛知识产权法的发展现状,还反映了立陶宛如何转化欧盟的知识产权立法。这些对于研究立陶宛和欧盟的知识产权法有一定的参考价值。
After Lithuania left the Soviet Union in 1990, this small country in Eastern Europe faced the challenge of rebuilding its intellectual property protection system. In 1992 Lithuania formed the national patent protection agency, the national IP office, and joined the International Intellectual Property Organization (WIPO) as an independent state. In the first decade after its independence, Lithuania promulgated the Trademark and Services Marking Law (1993), the Patent Law (1994) and the Law on Copyright and Neighboring Rights (1999) Property protection a series of important laws and regulations. In the 21st century, in preparation for its accession to the EU, Lithuania has continuously improved and introduced the relevant EU legislation in the field of intellectual property. On May 1, 2004, Lithuania joined the EU and became an important member of the EU’s intellectual property protection system. In the past few years, in order to encourage innovation and stimulate the economic vitality in the region, the EU has vigorously promoted the reform of intellectual property legislation. As a member of the European Union, Lithuania also constantly improves its own intellectual property protection system. The most notable achievements were the Law on Copyright and Related Rights, which was revised in 2004 for the third time, the new Patent Law of 2010 and the Trademark Law of the Fourth Revision in 2012. These three laws not only reflect the status quo of Lithuania’s development of intellectual property law, but also reflect how Lithuania transforms the EU’s intellectual property legislation. These have certain reference value for studying the intellectual property law of Lithuania and EU.
