征收土地产生的土地补偿费,可以由农村集体经济组织或者村民委员会、村民小组,依照法律规定的民主议定程序在本集体经济组织内部分配。而集体经济组织成员如何确定,现行立法缺少明确规定,结合征地补偿费用纠纷案,对征地补偿请求权产生的依据以及集体经济组织成员确定进行有益探讨,以期为未来相关立法提供合理建义。
Land compensation fees for land acquisition may be distributed within the collective economic organization by the rural collective economic organizations or village committees and villager groups in accordance with the procedures of democratic agreement stipulated by law. However, how to determine the members of the collective economic organizations, the current legislation lacks explicit provisions, combined with land acquisition compensation claims disputes, the basis for claims arising from land acquisition and the establishment of collective economic organizations to conduct a useful discussion, with a view to providing a reasonable future legislation.
