张晓萍博士的《民间法的司法运用》一书,以如何通过司法应对中国的社会转型为问题意识,体现了国内民间法研究从社会场域向司法场域的转向;该书在研究进路上实现了多元理论的视域融合,力图发展以适应社会转型需求的本土特色的法律方法论,以增强法律方法论回应法治实践的能力;该书通过立足司法立场的微观论证,对民间法司法运用的方法、程序以及制度保障进行了系统论述,对指导转型社会基层法院的司法实践具有重要意义。
Dr. Zhang Xiaoping’s “The Use of Justice in Civil Law”, a book on how to deal with China’s social transition through judicature as a problem consciousness, embodies the shift of domestic folk law research from the social field to the judicial field; This paper tries to develop a local legal methodology that meets the needs of social transformation in order to enhance the capacity of legal methodology to respond to the practice of the rule of law. Based on the microcosmic justification of judicial position, this book analyzes the method of judicial application of civil law, Procedure and system guarantee are systematically discussed, which is of great significance to guide the judicial practice of the grass-roots court in transitional society.
