仲裁员在接受指定以及在整个仲裁程序中应该是公正的,并且独立于当事人。仲裁员的独立性与公正性不仅直接关系仲裁的公正与效率,还是制约仲裁制度发展的一个关键因素。在保障仲裁员的独立性与公正性的一系列制度中,仲裁员的披露制度发挥着重要作用。本文通过研究仲裁员披露制度来探讨我国仲裁员披露制度的建立与完善,并对我国如何构建仲裁员披露制度提出建议。

The arbitrator should be impartial and independent of the parties in accepting the designation and throughout the arbitration proceedings. The independence and impartiality of arbitrators not only directly affect the fairness and efficiency of arbitration, but also restrict the development of arbitration system as a key factor. In a series of systems that guarantee the independence and impartiality of arbitrators, the arbitrator’s disclosure system plays an important role. This paper discusses the establishment and improvement of the arbitrator’s disclosure system in our country by studying the arbitrator’s disclosure system and gives some suggestions on how to construct the arbitrator’s disclosure system in our country.
