随着时代的发展,居住权制度也不断的得到完善,其功能已从单一的生存保障扩展到房屋投资领域,越来越适应现代商品经济的发展.从实践情况来看,居住权制度不仅能够满足人们利用房屋形式多样化的需求,而且能够为弱势群体的基本住房权利提供制度保障.因此,我国有设立居住权制度的必要,在物权法定主义之下,应当通过特别立法的形式将居住权纳入我国现有的物权体系.
