在我国古代,虽然有强大的行政官僚体制,却没有独立专门的行政管理机构对具体事务的管理。在近代西方打开中国大门,在经过了百日维新、清政府立宪的行政体制的萌芽阶段,为此后的行政体制和行政法的发展奠定了基础,踏实了路线,加之经验与实践的总结,对行政理论的升华带来了无尽的影响,并且对未来的发展指明了方向。本文试图通过百日维新及清政府立宪,简要分析西方的法律文化思想对我国晚清时期行政体制思想的变迁的影响,以及对未来行政思想的进步所提供的理论财富进行探索。
In ancient China, although there was a strong administrative bureaucracy, there was no management of specific affairs by an independent and specialized administrative agency. Opening the door to China in the modern West has laid the foundation for the subsequent development of the administrative system and administrative law after the reform of the Hundred Days of Reform and the Qing government’s constitutional establishment and has solidified the line and summed up the experience and practice. Sublimation of administrative theory has brought endless impact, and pointed out the direction of future development. This paper attempts to briefly analyze the impact of Western legal and cultural thoughts on the vicissitudes of the administrative system in our country in the late Qing Dynasty and to explore the theoretical wealth provided by the progress of administrative thinking through the Hundred Days of Reform and the Qing government’s constitutional amendment.
