国际私法中的识别制度是一个是十分复杂的法律制度,然而却又是特别重要的法律制度。它是审理国际民事案件的第一步,依据不同的法律意识和法律观念来识别,会适用不同的冲突规范,在这个基础上确定不同的准据法,最后令到案件的判决结果有所不同。所以识别的研究极为重要。关于识别的各个问题,尤其是识别的对象、识别的标准等存在着诸多争论,本人也想就几个问题谈谈自己的一点见解。
The identification system in private international law is a very complicated legal system, but it is a particularly important legal system.
