随着国际贸易的发展和国际经济一体化趋势的加深,国际双边投资保护协议越来越需要一个更为稳定和标准明确的发展方向,双边投资保护协议统一化将是其未来的发展趋势和选择之一。本文第一部分对双边投资保护协议的概念、性质、基本问题进行简要分析,侧重探讨双边投资协议与双边投资保护协议之间的历史联系;第二部分阐述了中欧双边投资保护协议的背景,重点分析了中欧双边投资保护协议统一化的必要性与可能性;第三部分讨论了中欧双边投资保护协议统一化的发展对中国、欧盟乃至世界经济的影响。最后文中提出中欧双边投资保护协议统一化将是一个复杂漫长的过程,中国作为协议一方,面临着一些挑战和困境,需要我们在谈判中不断的争取机会,最终实现最大程度的保护投资者利益的同时,促进中欧经济和贸易的共同发展。
With the development of international trade and the deepening of the trend of international economic integration, international bilateral investment protection agreements increasingly need a more stable and well-defined development direction. The unification of bilateral investment protection agreements will be its future development trend and choice one. The first part of this article gives a brief analysis of the concept, nature and basic issues of bilateral investment protection agreement, focusing on the historical relationship between bilateral investment agreements and bilateral investment protection agreements. The second part elaborates the background and key analysis of the bilateral investment protection agreements The necessity and possibility of the unification of the bilateral investment protection agreement between China and the EU; the third part discusses the impact of the unification of China-EU bilateral investment protection agreement on the economy of China, EU and even the world. Finally, it is proposed that the unification of bilateral investment protection agreement between China and the EU will be a complicated and lengthy process. China, as a party to the agreement, faces some challenges and difficulties, and it requires us to continuously strive for opportunities in the negotiations and finally to maximize the protection of the interests of investors At the same time, promote the common development of economy and trade between China and the EU.
