刑事审判监督是刑事诉讼活动中十分重要的具有预防和救济双重功能的制度,近年来司法改革过程中刑事审判监督暴露了一些异化的现象和问题,虽然新刑诉法对我国的包括刑事审判监督制度的再审抗诉、检察长列席审委会在内的一系列制度进行了修改和完善,但某些方面相对司法实践的需要而言仍然存在滞后性,为了进一步了解和研究刑事审判监督的相关理论,完善我国的刑事审判监督制度,结合前文关于刑事审判监督制度的纵向和横向的分析,本文最后从理论研究和实践实证调查分析两个大的方向重新审视和探讨如何进一步完善刑事审判监督制度。
Criminal trial supervision is a very important system of prevention and remedy in criminal procedure activities. In recent years, criminal trial supervision has exposed some alien phenomena and problems in the judicial reform. Although the new criminal procedure law has a great impact on our country including criminal trial supervision System retrial and protest, Attorney General attend the trial committee, a series of systems were revised and improved, but some aspects of the relative judicial practice needs still lag, in order to further understand and study the theory of criminal trial supervision , And improve our country’s criminal trial supervision system. Combined with the longitudinal and horizontal analysis of the previous criminal trial supervision system, this paper finally re-examines and explores how to further improve the supervision system of criminal trial from theoretical research and practical investigation.
