很多人对专利还存在诸多误解,因此,有必要进行一些分析和澄清。基于现实案例和实践操作,我认为,专利权的最大利益是为品牌做推广,而不是轻易去主张权利。专利分为发明专利、实用新型专利和外观设计专利三种,每种专利的价值大不相同,其中发明专利必须经过专利局实质审查,而实用新型和外观设计这两类专利则不经过实质审查,其经初步审查而没有发现驳回理由后,即由专利局颁发相应的专利证书。所以,相对而言,发明专利的含金量最高,其受保护的力度也最大。
