村民委员会组织法第15条规定:“以威胁、贿赂、伪造选票等不正当手段,妨害村民行使选举权、被选举权,破坏村民委员会选举的,村民有权向乡、民族乡、镇的人民代表大会和人民政府或者县级人民代表大会常务委员会和人民政府及其有关主管部门的举报,有关机关应当负责调查并依法处理。以威胁、贿赂、伪造选票等不正当手段当选的,其当选无效。”
