近年来,民间法受到广大学者的重视,民间法广泛存在于社会之中,它与国家法之间既有冲突,又有相互融合的地方。民间法以自身的特点,在社会生活中发挥着不可替代的作用。本文试图从法律文化的角度对民间法的特征和存在的社会基础,民间法与国家法之间的冲突与和谐发展进行研究,以期更好地实现法治建设的目标。
In recent years, the civil law has drawn the attention of the majority of scholars. The non-governmental law exists widely in the society. It has both the conflict with the national law and the place where the civil law merges with each other. The folk law, with its own characteristics, plays an irreplaceable role in social life. This article attempts to study the characteristics and existing social foundation of the folk law, the conflict and the harmonious development of the folk law and the national law from the perspective of law and culture in order to better achieve the goal of the rule of law.
