我国政府的入世承诺中包括对药品专利进行保护的一系列承诺,这既是我国在知识产权国际保护方面应当承担的国际义务,亦表明了我国力图改变对药品专利保护不力的现状的决心。本文以我国关于药品专利保护的承诺为基础,通过对药品专利保护制度的客观分析,建议立足于国情,根据TRIPS协定的制度框架,借鉴发达国家药品专利保护立法实践的先进经验,总结制药业较发达的发展中国家的教训,创建具有中国特色的药品专利保护制度。
Our government’s WTO accession promise includes a series of commitments for the protection of pharmaceutical patents. This not only serves as our country’s international obligations in the international protection of intellectual property, but also demonstrates our determination to change our country’s status quo in the protection of pharmaceutical patents. Based on our country’s promise of drug patent protection, through the objective analysis of drug patent protection system, this paper suggests that based on the national conditions, based on the institutional framework of TRIPS agreement and advanced experience of legislative practice of drug patent protection in developed countries, Developed developing countries, the lessons learned, to create a Chinese patent drug protection system.
