抽象行政行为是行政主体针对不特定相对人实施的具有普遍约束力的行政行为,在行政权的行使中,对抽象行政行为的监督显得尤为重要。在我国抽象行政行为司法审查还不健全的情况下,通过对现有的几种抽象行政行为监督机制的现状及局限性进行探讨。提出完善其监督机制的构想,为进一步完善抽象行政行为的司法审查奠定了基础和条件。
The abstract administrative act is a kind of universal binding administrative act that the administrative subject carries out to the non-specific opposite person. It is very important to supervise the abstract administrative act in the exercise of the executive power. In our country, the judicial review of abstract administrative actions is still not perfect, and the status quo and limitations of several existing administrative supervision mechanisms are discussed. Put forward the conception of perfecting its supervision mechanism, laid the foundation and conditions for further improving the judicial review of abstract administrative acts.
