在探讨惩罚性赔偿制度相关概念的基础上,对补偿性与惩罚性赔偿制度进行比较,找出惩罚性赔偿制度在适用上存在的缺陷,并提出相关制度建议。
On the basis of discussing the related concepts of punitive damages, the author compares the compensatory and punitive damages and finds out the defects in the application of the punitive damages, and puts forward the relevant institutional suggestions.
