目前，全国人大常委会正在审议《海域使用管理法（草案）》（以下简称草案）。草案建立的初衷是借鉴土地管理制度和国外经验，对建设工程占用海域实施管理。但是该草案又进一步将范围扩大到渔业生产，扩大到广大渔民，增加了渔民用海收费的具体实施步骤和办法。这对占海洋经济总产值 ５３％的海洋渔业的发展，对沿海地区主要用海主体的广大渔民的生产生活，于法于理都是不适当的。因此，处理不好将严重影响我国沿海渔区基本经济制度，影响渔民生产生活及社会稳定。那么以发放“海域使用证”为主体的海域使用管理制度，对渔业生产的科学管理、对现有的稳定的渔区基本经济制度将带来什么影响？该“证”的发放是否符合国际渔业管理的惯例？是否偏离了从国情、从人民群众的根本利益出发的基本原则？是否与现有的国家相关法律法规相抵触？是否考虑了渔业资源的独持性？是否考虑了沿海人民世代靠海而居、依海为生的公民的权利？是否给广大渔民增设了一道不低的门槛？为此本刊将我国几位著名的海洋经济学、海洋法学和渔业方面的专家意见和建议整理刊登，希望引起有关部门的重视。
At present, the Standing Committee of the National People’s Congress is examining the “Law on the Management of the Use of Sea Areas (Draft)” (hereinafter referred to as the draft). The original intention of the draft was to draw lessons from the land management system and foreign experience, the management of the sea occupied by construction projects. However, the draft further extends the scope to fishery production and extends it to the vast number of fishermen, increasing the specific steps and methods for fishers using the sea charges. The development of marine fisheries, which accounts for 53% of the total marine economic output value, is not properly justified in the law for the production and living of the vast majority of fishermen who use sea-dominated coastal areas. Therefore, poor handling will seriously affect the basic economic system of China’s coastal fishing areas and affect fishermen’s production and life and social stability. So how should the scientific management of fishery production affect the existing basic economic system of stable fishing area by using the management system of sea area using the “Certificate of Use of Sea Area” as the main body? Is the issuance of the certificate in conformity with the practice of international fisheries management? Has it deviated from the basic principle of starting from the national conditions and starting from the fundamental interests of the people? Is it in conflict with existing national laws and regulations? Have you considered the independence of fishery resources? Has it taken into account the rights of citizens living in the sea by sea and living off the sea from generation to generation? Is it not a low threshold for the majority of fishermen? To this end, we have compiled and published several well-known expert opinions and suggestions on marine economics, law of the sea and fisheries in our country, hoping to draw the attention of relevant departments.
