知识经济的兴起及经济全球化的发展,商业秘密的法律保护问题日益突显。我国已经加入WTO,其中的《与贸易有关的知识产权协议》(TRIPS)对我国区域内的商业秘密保护有一定的制约作用。本文试从商业秘密的权属、概念、特征,我国与TRIPS协议规定的差异等方面进行探讨,在此基础上提出完善我国商业秘密保护的建议。
The rise of knowledge-based economy and the development of economic globalization, the legal protection of trade secrets has become increasingly prominent. China has acceded to the WTO, and the “TRIPS Agreement” has a certain restraining effect on the protection of trade secrets in our region. This article tries to explore the ownership, concept and characteristics of trade secrets, the differences between China and the TRIPS agreement, and put forward suggestions on how to improve the protection of trade secrets in China.
