欧盟一直致力于在区域层面统一各成员国的知识产权边境执法(程序性)制度。自20世纪80年代至今,其共进行了四次关于知识产权边境保护的区域性统一立法。第一次立法是1986年颁布了“禁止假冒货物放行进入自由流通的措施的第3842/86号理事会条例”~①,该条例于1988年1月1日生效,于1995年6月30日失效。第二次立法是1994年颁布的“有关禁止侵犯知识产权货物申报进口进入共同体以及从共同体出口与复出口的措施的1994年12月22日的(EC)第3295/94号部长理事会条例”~①,该条例于1995年1月2日生效,于1995年7月1日实施,与1999年修改~②,于2004年6月30日失效。第三次立法是欧盟委员会于2003年1月提案,欧盟理事会于2003年7月22日通过的“关于针对涉嫌侵犯特定知识产权的海关行为及针对侵权货物的处理措施的(EC)第1383/2003号部长理事会条例”~③,该条例于2003年8月9日生效,于2004年7月1日起实施,于2013年12月31日失效。第四次立法即为本译文中的“关于知识产权海关执法并废止(EC)第1383/2003号理事会条例的2013年6月12日(EU)第608/2013号欧洲议会和理事会条例”。该条例于2011年由欧盟委员会提案,经一般立法程序于2013年6月通过,于2013年7月19日生效,条例中的部分条款也于同日开始实施,还有部分条款于2014年1月1日实施。第四次立法再次大幅度提升了欧盟知识产权边境保护的标准。~④
The EU has been working to unify IPR border enforcement (procedural) systems in member countries at the regional level. Since the 1980s, it has carried out four uniform regional legislation on the protection of the border of intellectual property. The first legislation was promulgated in 1986 by the Council Regulation No. 3842/86 prohibiting the release of counterfeit goods into free float. The Ordinance came into force on January 1, 1988, and in June 1995 30th invalid. The second legislation was promulgated in 1994 by the “Ministerial Council Regulation (EC) No. 3295/94 of December 22, 1994 on the Measures for the Suppression of the Infringement of Intellectual Property Goods by Declaring the Importation into the Community and the Export and Re-export from the Community The Ordinance came into force on January 2, 1995 and came into force on July 1, 1995, with the amendment in 1999 ~ 2 and lapsed on June 30, 2004. The third legislation was proposed by the European Commission in January 2003 and adopted by the Council of the European Union on July 22, 2003. The ”Decision on Customs Action against Alleged Infringement of Certain Intellectual Property Rights and Handling of Infringing Goods (EC) No. Ministerial Council Regulation (1983) No. 1383/2003, which entered into force on August 9, 2003, came into effect on July 1, 2004 and lapsed on December 31, 2013. The Fourth Legislative Order is the translation of the “Legislative Affairs on Enforcement of IPRs and Abolition of the Regulation (EC) No. 1383/2003 of the Council of 12 June 2013 (EU) No. 608/2013 European Parliament and Council Ordinance ”. The Ordinance was proposed by the European Commission in 2011 and passed through the normal legislative procedure in June 2013 and came into effect on July 19, 2013. Some of the provisions of the ordinance came into operation on the same day, with some provisions in January 2014 Implemented on the 1st. The fourth time, the legislation once again drastically raised the standard of border protection for intellectual property in the EU. ~ ④
