卫生监督是一种行政执法活动,自然存在管理一方和被管理一方。在实际工作中因这样或那样的因素,卫生监督管理一方(即卫生监督机构及其人员)行政违法时有发生,进而也引起一些有关卫生监督的行政诉讼案件发生。笔者认为总结一下卫生监督管理一方行政违法的内容,很有必要,扬长避短,有利于我们更好地履行国家赋予的卫生监督职权。
Health supervision is an administrative law enforcement activity, and it naturally exists on the side of the management and the party under management. In the actual work, due to one or other factors, the administrative violations of the health supervision and management (ie, the health supervision agency and its personnel) occur from time to time, and then cause some administrative lawsuits related to health supervision to occur. The author believes that it is necessary to sum up the content of administrative violations by one side of the health supervision and management, and to avoid any shortcomings. This will help us to better perform the powers of health supervision given by the state.
