种子行政执法机关属于行政机关,种子执法人员属于行政人员。法定职责必须为,法无授权不可为。实践中,由于不明确法定职责范围,导致种子执法人员不作为、乱作为、失职、渎职,或者司法机关错误追究种子执法人员法律责任的案件时有发生。本文利用司法机关错误追究种子执法人员在种子执法过程中玩忽职守法律责任的典型案例,谈谈与种子执法人员法定职责范围有关的几个问题。1案例简介
The seed administrative law enforcement organs belong to the administrative organs and the seed law enforcement officers belong to the administrative staff.
