论法治及其在社会矛盾纠纷解决中的价值

改革开放之后,我国进入社会转型期,矛盾纠纷不断增多,严重影响着社会的稳定与和谐。从表面上看,社会财富分配不均、诚信缺失、矛盾纠纷解决机制不健全、政府职能的异化是造成当前社会矛盾高发的主要原因。然而,如果深入思考,不难发现,社会矛盾纠纷产生的根源仍在于法治的缺失。因此,系统探寻法治在社会矛盾纠纷解决中的作用,能够对我国当前和谐社会的建设有所启示。

After the reform and opening up, China has entered a period of social transformation and its contradictions and disputes have continuously increased, seriously affecting the stability and harmony of the society. On the surface, the distribution of social wealth is uneven, the integrity is missing, the mechanism for resolving contradictions and disputes is not perfect, and the alienation of government functions is the main reason for the current high social conflicts. However, if we think deeply, it is not hard to find that the root cause of social conflicts and disputes still lies in the absence of the rule of law. Therefore, the system to explore the role of the rule of law in the resolution of social conflicts and disputes can provide some inspiration to the current construction of a harmonious society in our country.
