根据《信息网络传播权保护条例》第26条,网络传播权全称为信息网络传播权,是指以有线或者无线方式向公众提供作品,使公众可以在其个人选定的时间和地点获得作品的权利。法条明确规定,无论是以任何形式发表的作品,无论作品是不是利用网络第一次发表,只要是受著作权法保护的,其著作权人均享有信息网络传播权。
According to Article 26 of the “Regulations on the Protection of the Right to Propagation of Information Networks”, the full name of a network communication right is the right to information network dissemination. It refers to providing works to the public by wire or wireless so that the public can obtain works at the time and place of their choice right. The law clearly stipulates that no matter a work published in any form, regardless of whether the work was published for the first time by using the Internet or not, as long as it is protected by the Copyright Law, every copyright holder shall enjoy the right of information network dissemination.
