监护是为保护无民事行为能力人和限制民事行为能力人的人身和财产权利而特定公民或组织对其予以监督、管理和保护的制度。无民事行为能力即不具有以自己的行为取得民事权利、承担民事义务的资格。我国《民法通则》规定,不满10周岁的未成年人及不能辨认自己行为的精神病人是无民事行为能力人。限制民事行为能力即只具有部分的民事行为能力,享有民事权利和承担民事义务的资格受到一定的限制。在我国,10周岁以上的未成年人及不能完全辨认自己行为的精神病人是限制民事行为能力人。监护人是对无民事行为能力人和限制民事行为能力人的人身、财产权利和其他一切合法权益负有监护职责的人。包括法定监护人、指定监护人、遗嘱监护人和委
