农家女嫁到城镇后因生活困难引发的信访问题,是当前影响社会稳定的一个重要因素。为此,笔者就西湖区农嫁居妇女信访问题及调处工作进行了调查,提出一点粗浅的看法,以求共磋。一、引发农嫁居妇女信访问题的原因在我国,由于实行了农业户口和居民户口“二元制”的户籍管理制度,因此也就存在了农业户口的女性嫁给城镇居民男性为妻后,户口仍在农村的现象,即:农嫁居妇女这一说。那么,引发农嫁居妇女信访问题的根本原因在于农嫁居妇女权益得不到很好的维护所致。我国社会主义制度建立后,宪法、法律、法规虽对妇女权益的保护作了规定,但在实际操作中,广大农嫁居妇女的权益却没有得到全面的保护和保障,主要表现在:一是在住房分配和宅基地审批中农嫁居妇女的权益得不到保障。城市住房分配因为女方为农业户口人员,无权享受男方单位的分房面积;农村建房因男方户口不在本村,无法单独立户,也就不能审批宅基地,农嫁居妇女就成了两头都得不到保障的一个群体。二是土地承包过程中存在损害农嫁居妇女合法权益的现象。
