在我国法制建设日益发展的背景下,无固定期限劳动合同制度成为新《劳动合同法》的一个亮点,备受法律学者们的瞩目。劳动法立法越来越重视保障劳动者的合法权益,无固定期限劳动合同便是其可以应用的有力武器。但是,由于我国法制还不健全,法学界对于无固定期限劳动合同的研究尚浅,缺乏一些针对性的比较具体的观点,因此,在立法上也必然存在一定的缺陷和问题,所以,通过了解无固定期限劳动合同制度的现实困境与缺陷,分析出其出现的原因,从而提出有效的完善方法,以此发挥无固定期限劳动合同制度的现实意义。[1]
Under the background of the increasingly development of legal construction in our country, the non-fixed term labor contract system has become a bright spot of the new “Labor Contract Law”, attracting the attention of legal scholars. Labor law legislation is placing more and more emphasis on safeguarding the legitimate rights and interests of workers. A labor contract with no fixed term is a powerful weapon to which it can be applied. However, due to the imperfect legal system in our country, there is still a paucity of pertinence and specific opinions in jurisprudential studies on labor contracts with no fixed term. Therefore, certain deficiencies and problems are bound to exist in the legislation. Therefore, by understanding Without the fixed-term labor contract system, the author analyzes the reasons for the emergence of the labor contract system and puts forward the effective ways to improve it, so as to give full play to the practical significance of the labor contract system without a fixed term.
