随着我国经济的快速发展,建筑行业逐渐发展成为推动国民经济发展前进的支柱产业之一。建筑行业的快速发展有效的带动了社会经济增长,解决了许多劳动力的就业问题,对社会稳定和经济发展具有十分重要的作用与意义。但是不可忽视的是,建筑工程的安全问题和安全事故时有发生,给人们的生产生活带来极大的隐患和影响。目前影响建筑工程施工质量的最大安全隐患是建筑施工企业超越资质进行建筑施工,甚至是缺少施工资质。因此,本文初步阐述了施工资质的概念以及相关性质,分析介绍了强制性规定对合同效力的影响,最后具体介绍了施工资质对建筑工程施工合同效力产生影响。
With the rapid economic development in our country, the construction industry has gradually developed into one of the pillar industries for promoting the development of the national economy. The rapid development of the construction industry has effectively brought about social and economic growth, solved many employment problems of the labor force and played an important role and significance in social stability and economic development. However, it can not be neglected that the safety of construction projects and accidents have occurred from time to time, bringing great hidden danger and impact to people’s production and life. At present, the biggest potential safety hazard that affects the construction quality of construction projects is that construction enterprises surpass the qualifications for building construction and even lack of construction qualification. Therefore, the paper preliminarily elaborates the concept and related nature of construction qualification, analyzes and introduces the influence of mandatory regulation on contract effectiveness, and finally introduces the influence of construction qualification on the effectiveness of construction contract.
