贯穿古代社会的“等级”观念对于中国传统法律制度及文化的影响可谓积厚流广,但是其内涵却常被现代人错误解读。等级制并非身处统治阶级的特权者对平民的剥削和压榨,它其实是一种对等、双向的行为规范——无论社会身份的君臣、官民,还是家庭身份的夫妇、父子,都应严格遵守那一套由自己身份所决定的行为规范,从而形成国家良好的秩序和风俗。作为后来者,我们不仅不应鲁莽地批判一个在传统社会中达成共识的理念,而且应探求它的合理性、生命力及重塑的可能。
