“独立公投”作为民族自决权的重要内容,对被殖民国家和民族摆脱殖民统治起到非常重要作用,在最初与国家主权并无矛盾。而当“独立公投”被运用到主权国家中民族或者部分区域独立时,引发了民族自决权和领土完整权的巨大冲突。现阶段民族自决权范围模糊,缺乏精细的国际法规制使得“独立公投”甚至沦为大国政治工具。需要对其所依托的民族自决权有所取舍,更利于当今时代发展。
As an important part of the right of peoples to self-determination, “independence referendum” plays an important role in getting colonial countries and nations out of colonial rule and initially has no contradiction with the sovereignty of the country. When “independent referendum” was applied to the national or partial independence of sovereign countries, it triggered a huge conflict over the right of peoples to self-determination and territorial integrity. At this stage, the scope of national self-determination is ambiguous. The lack of elaborate rules of international law makes the “referendum” even reduced to a political tool for the great powers. It is necessary to give some choices to the national self-determination that it depends on, which is more conducive to the development of the present era.
