本文是由孙牧华的结构设计引发的一则著作权纠纷,孙牧华的结构设计有一定的纸质表现形式,其一方面具有一定的艺术性,同时也具有较高品位的文化性,其毋庸置疑体现了作者的组织创造能力,是作者的智力劳动成果,具备了独创性、可复制性和广泛传播性,属于著作权的作品范畴。我认为袁化生与孙牧华因缺乏合作创造的合意而不具备合作作者的身份关系,袁化生的作品完全是对孙牧华作品的补充和完善,是从孙牧华作品中新派生出来的作品,属于演绎作品的范畴,故其在不侵害原作品著作权人相关利益的情况下,可以对自己的独创的演绎作品享有著作权。
