近年来,未成年人犯罪呈上升趋势,检察机关作为法律监督机关,在办案过程中积极进行犯罪预防是其社会管理的体现。目前我国检察机关在未成年人犯罪预防中存在过于注重法律效果、职能一体化程度不足等问题。本文针对上述问题提出改变执法理念、加强未检职能一体化、强化刑罚执行监督等改善措施。
In recent years, juvenile delinquency has been on the rise. As the supervisory organ of law, the procuratorial organs have actively carried out crime prevention in the process of handling cases as the embodiment of their social management. At present, procuratorial organs in our country have placed too much emphasis on the legal effect in the prevention of juvenile delinquency and the problems such as the insufficient degree of functional integration. In view of the above problems, this paper proposes some measures to improve the concept of law enforcement, strengthen the unification of unjustified functions, and strengthen the supervision of penalty execution.
