粤劳社[2003]149号各市、县劳动保障局(社保局),省直各有关单位:根据省劳动保障厅、省经贸委、省财政厅印发的《广东省国有劣势企业职工分流安置工作的意见》(粤劳社[2001]262号),社会保险关系由省直接管理的省属劣势企业职工,距法定退休年龄不足5年的,经企业与职工双方协商同意,企业可以在与职工解除劳动合同后不再支付经济补偿金,职工经济补偿金全部转作生活费和社会保险费。为规范省属国有劣势企业分流职工生活费发放工作,我厅制订了《省属国有劣势企业分流职工生活费发放管理办法》,现印发给你们,请遵照执行。二○○三年十一月二十四日
