根据旅游是先交钱,后上路的消费特点,旅游合同自然成为旅游者的护身符。尽管有其他的事实认证,但是旅游者与旅行社或个人发生纠纷,旅游管理部门进行裁定的重要依据仍然是合同。旅游者出行前一定要与旅行社签订旅游合同,明确游览景点数目、导游服务标准、旅行社应承担的责任和义务等。如果旅行社不按合同办事,如改变住宿酒店星级、降低用餐标准、卧铺变硬座等,旅游者要将其违约事实和造成的后果真实记录下来,以便今后向有关部门投诉。反之,旅游者的协议变更,如暂时离团、返回等也要事先通报旅行社,并最好达成书面协议,擅自变更,要小心旅行社反投诉。对导游改变行程,收受回扣等现象,经查实后,是要按有关规定给予处罚的。
