无论从市场经济发展的历史考察,还是从现代市场经济的发展看,市场经济的运行机制必须法制化。那么,在市场经济运行的过程中,应该坚持哪些法律原则呢?笔者认为,至少应该有以下几个原则。 一、主体平等原则 市场经济运行的主体,是市场经济构成的基本要素,没有成干上万的经济主体在市场上按照价值规律、竞争规律、供求规律等进行纷繁复杂和活跃的经济活动,就没有市场经济。参与市场经济活动的主体主要有自然人、法人及其他社会组织。国家有时也可以作为特殊的市场主体。主体平等原则是市场经济正常运行的最根本的原则:
