党的十八届四中全会鲜明提出了“依宪治国”、“以法行政”的总原则,对法治建设作出全面部署。法治的关键是把权力关进笼子,力求最大限度地减少权力扭曲。宪法是根本大法、最上位的法,法治体系的建立,逻辑上首先要动态优化宪法,并在此基础上建立完善的法律体系。我国实现国家治理现代化的目标,必须以法治化建设的进步来提供保障条件。
The Fourth Plenary Session of the 18th CPC Central Committee clearly proposed the overall principle of “administering the country according to the constitution,” and “running the country with the rule of law,” and made a comprehensive plan for the construction of the rule of law. The key to the rule of law is to cage power and try to minimize the distortion of power. Constitution is the basic law, the most important law, the establishment of the rule of law system, the logic must first dynamically optimize the constitution, and on this basis to establish a sound legal system. In order to achieve the goal of the modernization of state governance, our country must provide the guarantee conditions by the progress made by the rule of law.
