代表人诉讼是从英美衡平法上发展而来的一种诉讼制度。经过几个世纪的演变,代表人诉讼从形式到内容都有极大的丰富和发展。代表人诉讼是一种减少诉讼成本的诉讼制度,有利于将人数众多的弱小一方组织起来,共同对抗强势群体。本文通过比较中英两国的代表人诉讼制度,来更好的认识了解我国的代表人诉讼制度,从而更加有效的保护普通民众的合法权利。
Representative litigation is a lawsuit system developed from the balance of power between Britain and the United States. After several centuries of evolution, the representative litigation has greatly enriched and developed from the form to the content. Litigation is a litigation system to reduce the cost of litigation, which is conducive to the organization of a large number of weak parties to jointly fight against the strong groups. By comparing the representative litigation system in China and the UK, this article tries to better understand the representative litigation system in our country so as to protect the legitimate rights of ordinary citizens more effectively.
