依法处罚交通违章是维护正常的道路交通秩序、减少交通事故,提高交通安全意识的一项重要手段。交通违章处罚按照我国的法律规定属于行政处罚范畴,应当严格遵循法律、法规有关行政处罚的原则和规定,但从当前的道路交通管理实践来看,交通违章处罚在适用行政处罚程序方面存在一些问题,不能适应和满足现阶段和今后的执法实践的需要,直接影响到道路交通管理工作的正常开展,应作适当修改。
